The new Electronic System for Travel Authorization (ESTA) requires all travellers intending to visit the U.S. without a visa to submit an electronic form in advance of travel. Eligibility to travel without a visa is required and will be sent to the applicant through ESTA. If you are rejected, you may be eligible for a visa from a U.S. Consulate abroad. Obtaining legal counsel is advised if rejected. Like all applications for U.S. immigration benefits, representations made on forms are under penalty of perjury. Failure to provide truthful and complete information can lead to benefit denial and/or misrepresentation as a ground for exclusion, denial of future visas and green cards, or removal from the U.S.
